COMPLIANCE & CC&Rs ENFORCEMENT
Mountain Park is a planned community. The Mountain Park Declaration of Restrictions, established in 1968, sets forth the rules for our community. The Codes, Covenants, and Restrictions (CC&Rs) were established to protect property values and preserve the appearance of our community. The value of every home depends in part to the appearance of the homes around it, therefore all owners benefit when the Declaration of Restrictions is adhered to.
In 1997, at the direction of the board of directors, a committee of homeowner volunteers spent considerable time reviewing the Declaration of Restrictions and created the Declaration of Restrictions, Guidelines, & Clarifications that more clearly defines those restrictions. The committee then developed a proposal that was submitted to the board. Modifications were made as a result of careful review by the board, legal counsel and from suggestions submitted by our members.
The desired outcome of the Declaration of Restrictions, Guidelines, & Clarifications is for residents to understand and more fully comply with the regulations that govern the Mountain Park community. Simple maintenance such as upkeep of lawns and landscaping and storing trash cans out of sight have a large effect on overall appearance.
The information in this section is intended to help you, your designer, architect, builder, contractor and/or landscape professional to understand these guidelines regarding home design and landscaping, as well as acquaint you with the necessary approval process that each submittal entails. The board wants to ensure that the design review and approval process is administered fairly and effectively for the benefit of individual property owners and for Mountain Park as a whole.
The association has adopted a set of fines and penalties for infractions of the CC&Rs and association policies. All properties within Mountain Park (including commercial properties which are not subject to assessments) are subject to this enforcement program.
